1. Definition
The following terminology applies to these Terms and Conditions and Privacy Statement:
"Client", “You” and “Your” refers to you, the person accessing and using this website to place an order, commission or design and accepting the terms and conditions of atelier28.net. "atelier28", “Ourselves”, “We” and "Us", refers to atelier28.net.

2. Applicability
2.1 atelier28, located at Botermarkt 1, 4691CZ Tholen, Netherlands, offers clients via her website www.atelier28.net the opportunity to order her products.
atelier28 is registered by the ‘Kamer van Koophandel’, number 20153961
2.2 atelier28 has the right to change these Terms and Conditions and the content of its website.

3. Agreement
3.1 The Agreement between you and atelier28 applies the moment you:
a) place an order through the website of atelier28 (www.atelier28.net) by fully and correctly completing the order form,
b) have received a confirmation e-mail from atelier28 with details of your order.
 
4. Delivery
4.1 All our products remain our property until they are paid for in full.
4.2 The delivery of ordered products will be subject to availability. If certain products are not available then you will receive an e-mail from atelier28 as soon as possible.
4.3 The delivery of ordered products will be to the client’s specified delivery address. The cost of postage will be borne by the client.
4.4 Delivery takes place after receipt of payment 
4.5 The agreed price of artwork includes 19% VAT or any other applicable rate at the time of sale.
4.6 Since most products from atelier28 are specifically made for customers, cancellation of an order may incur charges.
4.7 atelier28 packs all products carefully for postage and is therefore not liable for damage or loss of items during shipping.

postage costs are:

    * Within Netherlands: € 2.00
    * Within EU: € 3.00
    * Outside EU: € 5.00

5. Force Majeure
5.1 If due to force majeure atelier28 cannot fulfil its obligations, they shall be suspended for the duration of the conditions.
5.2 If the ‘Act of God’ has lasted 30 days, both parties have the right to withdraw in whole or in part by means of a written statement without compensation. Atelier28, if applicable, has an obligation to return the amount already paid to the customer.
5.3 atelier28 and the recipient should inform each other as soon as possible in writing (if possible) of a force majeure situation.

6. Personal information
6.1 atelier28 treats personal information from clients strictly confidentially and the information is not sold to third parties.
6.2 atelier28 is obliged to remove personal data of the buyer from its files if the client so wishes.

7. Complaints
7.1 Complaints concerning visible defects shall only be considered within 5 working days of receipt of the products.  These should be submitted in writing to atelier28. By exceeding the time limit of 5 working days the buyer loses all rights and powers of any defects and / or complaints.
7.2 atelier28 will try to resolve the complaint within 14 days. Atelier28 will provide you with written messages. If a complaint is valid, atelier28 will, in accordance with the Civil Law, endeavour to replace or restore the product.
 
8. Intellectual property
8.1 All designs and products are the intellectual property and copyright of atelier28. Where there is an infringement of intellectual property, atelier28 will take action in accordance with the applicable law.
8.2 atelier28 may use articles made in commission as examples of her portfolio on www.atelier28.net.

9. Legal
9.1 The relationships between the client and atelier28 are in accordance with Dutch law.
9.2 All disputes between the client and atelier28 would be settled by the civil court in Middelburg, Netherlands.
